What happens in a New Jersey divorce
Every case is different, but most follow the same path. Here it is, start to finish.

First meeting
We sit down, go through your situation, and tell you plainly where you stand and what your choices are.

Filing a complaint based on the grounds
A Complaint for Divorce starts the case, and it has to state the grounds. Most New Jersey divorces are filed as irreconcilable differences, which does not require blaming anyone. New Jersey best practice is no more than one year from filing to Final Judgment, though not every case fits that.

Gathering the information
Both sides exchange financial records. Assets are identified and valued, sometimes with an accountant when a business is involved.

Agreed or contested
If you both agree on custody, support, assets and alimony, the divorce is uncontested and moves faster. If not, it is contested.

Only if they are reasonable
Negotiation and mediation can work, but only when the other side deals in good faith. We will not trade away what you are owed to avoid a fight.

Trial
If they will not deal fairly, we try the case. New Jersey divides assets equitably, which does not always mean equally, so we go in prepared to argue for every piece of yours.

Final judgment
The court enters a Final Judgment of Divorce. If life changes later, alimony, support and custody can be modified.
